In that case the congress has the power to create new federal courts. The artice of the constitution that gives this power is the article I section 8 that says the following: The Congress shall have power ........To constitute tribunals inferior to the Supreme Court. Hae in mind that Federal Courts have limited subject matter jurisdiction. They can only hear cases that fall both within the scope defined by the constitution in Article III
